International Law Enforcement Request Information Guide

This guide is intended for law enforcement agencies outside of Serbia that request user information about users of platforms managed by BINIS ALPHA ("user information"). BINIS ALPHA's main business operations are based in Serbia, although our websites and certain products and services may be available in other jurisdictions around the world.

This guide is subject to change without notice. This guide applies only to requests from a law enforcement agency. Nothing in this guide shall be used to create legal obligations or any rights against BINIS ALPHA.

BINIS ALPHA understands that there will be times when our assistance will be necessary to assist law enforcement agencies in the performance of their duties. BINIS ALPHA is committed to the highest business standards in our relations with our users, customers, suppliers, and business partners. We strive to be a good example of behavior following all applicable laws and regulations, while respecting the privacy of our users, customers, suppliers, and business partners.

BINIS ALPHA will not disclose or release user information without a valid, legally binding request (such as a subpoena, search warrant, court order or other legal process) ("request") submitted on an appropriate form through appropriate channels. BINIS ALPHA reserves its right to reject, in whole or in part, a request for user information that conflicts with the laws of Serbia or is inappropriate, unethical, and immoral.

Requests must generally be forwarded through various legal and/or diplomatic channels recognized by Serbia. Aha Law enforcement agencies must provide us with the following before we can process any request: a signed copy of the request; complete contact information, including but not limited to name, email address, telephone number, and physical address; identity verification credentials; detailed identification information of the targeted persons, including all known names, aliases, street addresses, email addresses, telephone numbers, platform IDs and, if applicable, relevant schedules and transactions; a detailed description of the requested user information, including a timeframe; a statement about the nature of the investigations or proceedings for which information about the user is required; valid legal basis for the request. BINIS ALPHA reserves all rights to require any law enforcement agency to reimburse costs incurred in responding to a request.

Copyright notice

BINIS ALPHA respects intellectual property laws. Accordingly, BINIS ALPHA accordingly expects all parties using the Websites and Services to respect BINIS ALPHA's copyright. BINIS ALPHA and/or its partners own the content (including but not limited to designs, logos, color schemes, graphics, text, images, and videos) on this Website. Any unauthorized copying, publication, reproduction, or distribution of copyrighted works constitutes a violation of the rights of the copyright owner and is therefore prohibited.

Unauthorized use of patents, trademarks, service marks, logos, slogans, screenshots, graphic styles, designs, copyrighted materials, or any branded features ("BINIS ALPHA Proprietary Property") without the prior written permission of BINIS ALPHA is strictly prohibited. If the rights of BINIS ALPHA are infringed with respect to any proprietary property, you will be ordered to cease such illegal activities and you will be strictly liable to BINIS ALPHA for any damages (including attorneys' fees) that may be incurred because of your infringement.

Limitation of liability

Please note that you have been informed and advised that you must be sure of what you wish for. We have several checkpoints to avoid the possibility of products missing from your order. The items in your order will be packed without the possibility of any product missing from the packaging. The items in your order will be shipped to you based on your order. If you are missing items from your orders, we strongly advise you to check with the courier service. Please note that customs may open and check the package. You must report the missing item to us by emailing a description of the missing item within 12 hours of receiving your order, and we will take all steps to correct the problem. All reports of missing items, sent after 12 hours from the moment of receipt of the shipment, will not be considered. Please check the entire order before filing a missing item claim, as only one missing item claim will be accepted per customer. There are no exceptions. The website or its owner cannot be held responsible for damage or destruction of goods during transport.

All materials downloaded or otherwise obtained through the Sites are downloaded by users without a warranty and each user is solely responsible for any damage to their computer system or loss of data that may result from downloading any such material. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY ANY USER OR FROM BINIS ALPHA OR THE SITE SHALL CREATE ANY WARRANTY EXCEPT AS EXPRESSLY STATED HEREIN.

The Site may make available to the User the services or products of third-party manufacturers. No warranties are made with respect to such services or products. In any case, BINIS ALPHA and our associates are not responsible for any service or products.

Each User hereby indemnifies and holds BINIS ALPHA, our partners, directors, officers, and employees harmless from all losses, claims, liabilities (including legal fees for full damages) that may arise from the use of the Site or the Service (including but not limited to the display of information about such users on the site) or violation of any rules and conditions by the user.

Each user shall by this additional clause protect and hold harmless BINIS ALPHA, our partners, directors, officers, and employees, against all losses, damages, claims, and liabilities (including legal expenses for full compensation) that may arise, directly or because of any claims submitted by complainants and or claims by independent persons or others, third parties related to the products offered or displayed on the site. Each user further agrees that BINIS ALPHA is not responsible, and shall have no liability to you, for any material posted by others, including defamatory, offensive, or illegal material, and that the risk of harm from such material rests entirely with each user.

BINIS ALPHA shall not and cannot be liable for any special, direct, indirect, intentional, punitive, incidental, or consequential damages or any damages resulting from any of the following: inability to use the sites or services; any defect in goods, samples, data, information or services purchased or obtained from the user or any other third party site; infringing the rights of a third party, or requiring that the User's manufacture, import, export, distribution, offer, display, procurement, sale and/or use of products or services offered or displayed on the Site may infringe or may be imposed to infringe a third party; rights to independent third-party access to any user's data or private information; the statements or conduct of any user of the Sites; any matter relating to the services arising, including negligence.

To the maximum extent permitted by law, the service is provided on an "as is" and "as available" basis, and BINIS ALPHA hereby expressly disclaims all warranties, express or implied, including but not limited to any warranties of condition, quality, durability, performance, accuracy, reliability, merchantability or fitness for a particular purpose. All such warranties, representations, terms, and conditions are hereby excluded. BINIS ALPHA does not make any guarantees about the validity, accuracy, reliability, quality, and stability, as well as the completeness of any information found on or through the site.

Any material downloaded or otherwise obtained through the use of the Service is done at each member's sole discretion and risk, and each member is solely responsible for any damage to the computer system or loss of data resulting from the downloading of any such material.

Under no circumstances shall BINIS ALPHA be liable for any delay or failure of services caused directly or indirectly by acts of nature, forces, or causes beyond its control, including without limitation, the quality of internet connection, computer, telecommunications, or any other equipment failures, lack of electricity, strikes, labor problems, riots, riots, civil disturbances, shortages of materials or labor, fires, floods, storms, explosions, acts of God, force majeure, war, government affairs, orders of domestic or foreign courts or tribunals or performance third parties. BINIS ALPHA will make reasonable efforts to keep the service operational. However, some technical difficulties or maintenance may, from time to time, result in temporary outages. BINIS ALPHA reserves the right, periodically and at any time, to modify or discontinue, temporarily or permanently, features and services, without notice, all without liability for any interruption, modification, or discontinuance of the service or any feature or item. You understand and agree that BINIS ALPHA has no obligation to maintain, support, modernize, or update the Service or to provide all or any particular content through the Service.

If you live in a country that is part of the European Union and have purchased a product online, you have the right to change your mind and receive a full refund within 14 days of purchase ("cooling off period"), but only if you have not started consuming the service or product , if you have not opened the transport package and under the conditions in the Return & Exchange & Refund section. BINIS ALPHA may change the price of products from time to time without prior notice.

These terms will continue to apply to you until your account is deleted by either you or BINIS ALPHA. BINIS ALPHA may terminate the Terms or suspend your access to the Service at any time, including in the case of suspected unauthorized use of the Service or non-compliance with the Terms. If you or BINIS ALPHA terminate the Terms, or if BINIS ALPHA suspends access to the Service, you agree that BINIS ALPHA shall have no obligation or liability to you.

We strive to provide the best services we can, but you understand and agree that the service is provided "as is", without express or implied warranties or conditions of any kind. You use the service at your own risk. BINIS ALPHA disclaims any warranties or conditions of merchantability or fitting for a particular purpose. In addition, BINIS ALPHA does not warrant, endorse, guarantee, or assume responsibility for any third-party application, third-party application content, user content, or any other advertised item or service offered by a third party or through the Service or any hyperlinked site, or featured in any advertising or other campaign. You understand and agree that BINIS ALPHA is not responsible for any transaction between you and third-party service providers or third-party products or services advertised on or through the Service. As with any purchase of a product or service through any medium or in any setting, you should use your own judgment and caution. Some aspects of this section may not apply in some jurisdictions. You agree that, to the extent permitted by applicable law, your sole and exclusive remedy for any problems or dissatisfaction with the Service is to stop using the Service.

To the fullest extent permitted by law, in no event shall BINIS ALPHA, its officers, shareholders, employees, agents, directors, subsidiaries, partners, successors, issuers, suppliers, or publishers be liable for any indirect, special, incidental, punitive, or consequential (including loss of use, data, business or earnings) damages, resulting from the use or inability to use the service, third-party applications or third-party application content, regardless of legal theory, regardless of whether BINIS ALPHA has been warned of the possibility of such damage, or BINIS ALPHA has warned you about the possibility of damage; aggregate liability for all claims related to the Service, Third Party Applications or Third Party Application Content.

These Agreements constitute the entire terms and conditions agreed upon between you and BINIS ALPHA and supersede all prior agreements relating to the subject matter of those agreements, whether written or oral. Any additional or different terms or conditions relating to the subject matter of this Agreement in any written or oral communication from you to BINIS ALPHA shall be void. You acknowledge that you have not entered into any agreements relying on any oral or written representations made by BINIS ALPHA that are not contained in the agreements contained herein.

These agreements are governed by the laws of Serbia, regardless of choice or conflict of law principles. Further, you and BINIS ALPHA consent to the exclusive jurisdiction of the courts of Serbia to resolve any dispute, claim, or controversy arising in connection with these agreements. If you are a user from the United States of America, this also applies to you. User and BINIS ALPHA agree that each may bring claims against the other only in its own capacity and not as a member of a class or in any representative capacity or proceeding. Further, no arbitrator shall consolidate the claims of other persons with his claims.

In no event shall BINIS ALPHA be liable for any delay failure or interruption of content or services delivered directly or indirectly due to natural disasters, including without limitation: Internet, computer, telecommunications, or other equipment failures, power outages, strikes, riots, insurrections, civil disturbances, labor or material problems, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals or failure of a third party.

Miscellaneous

Your order and products cannot be exchanged without your permission. There is no way to receive some exchanged items. Our order policy is as follows. We have placed informational images only for products that our partners have in stock in warehouses and for items that we make to order. We check all items with our partners once a day. If a product is sold by our partner and is no longer in stock, the image of that product will be removed from the store or will be written: "sold out". When you place an order, we immediately send a message to our partner and put the product in "Waiting" mode. After we receive your paid order, we will send you what you ordered. However, if, and we say, these products sell out in the time between your order and our message to our partner (a slim chance of that), we'll send you an email offering another similar product with customer credits in our store on the network. If you do not want another or similar product, we will pay the amount of your paid account, but less any bank commission or other money transfer fees. To cover some of the bank charges, we'll give you a special discount on your next order.

Some products with the attribute "selling fast" have a note about where we advise you to check the item first before paying for this item. Products with the attribute "handmade" are generally not 100% accurate to the photo in the store, but over 90% of the products are as the photo. The color, model, and dimensions are the same. However, some details (position of colors or position of subs) may be unclear and moved to the side.

All these terms and conditions are intended for users and customers to protect our business and reduce the incidence of fraudulent orders, fraudulent refunds, fraudulent charges, and the use of stolen credit cards. Thank you for your understanding.

BINIS ALPHA is the sole owner of all rights to the web service. The Service is the embodiment of trade secrets and intellectual property rights protected by law. All title, ownership, and intellectual property rights in the service remain with BINIS ALPHA or its affiliates. All rights not otherwise described herein are reserved. "BINIS ALPHA", "Related Icons" and "Logos" are trademarks and service marks of BINIS ALPHA and are protected under applicable copyright, trademark, and other proprietary rights laws. Unauthorized copying, modification, use, or publication of these marks is strictly prohibited.

The prices shown are a fee for the time, effort, and supplies used to create your custom cake images, muffins, lollipops, pops, cookies, printed and text card toppers and stickers, acrylic toppers, and cupcake wrappers. We do not sell images in digital form. All published images are informative. All digital character images used in custom designs are free and not for sale. We do not claim ownership of the characters or images used in your custom images, they belong to their respective copyright holders and are distributed by authorized dealers only. These images are permitted for one-time personal use under the doctrine of sale. They cannot be resold for any reason. Please note that you are paying for our services, material (repro material, substrate, paint, packaging), and time spent designing your image or thumbnail which is permitted for one-time personal use. These digital images are not licensed products; all character images are free and not for sale. We do not sell or claim ownership of the graphic character, graphics, or images.

- In general

This Agreement and Terms of Use constitute the entire agreement between Member and BINIS ALPHA with respect to the Service, superseding any prior written or oral agreement with respect to the same subject matter. BINIS ALPHA and the member, i.e. the customer, are independent entrepreneurs, and no agency, partnership, joint venture, employee-employer, or franchiser-franchisee relationship is created by this contract. The headings are for reference only and do not in any way define, limit, construe, or describe the scope or extent of such section. BINIS ALPHA has the right to assign this agreement (including all its rights, titles, benefits, interests obligations, and duties in this agreement) to any person or entity (including any subsidiaries). Member may not assign, in whole or in part, this Agreement to any person or entity.

This contract is governed by the laws of the Republic of Serbia. The parties to this agreement fall under the exclusive jurisdiction of Serbian courts. If there is any inconsistency between the Serbian version and another language version of this agreement, the Serbian version will prevail. If there is a conflict between the Serbian version and another language version of this contract, the Serbian version will prevail.

These agreements are governed by the laws of Serbia, regardless of choice or conflict of law principles. Further, you and BINIS ALPHA consent to the exclusive jurisdiction of the courts of Serbia to resolve any dispute, claim, or controversy arising in connection with these agreements. If you are a user from the United States, the EU, or any other country, the binding arbitration laws of the terms and conditions also apply to you, so please read them carefully.
